Frequently Asked Questions

  • What are the appointments and terms of notaries public?

Notaries Public are always appointed by the Governor – for judicial officers the practice remains the same. Notaries are legally allowed to hold their offices for seven years. At the end of this time period, the consent from the Government is re-obtained again.
  • May I notarize a document written in a foreign language?

Sure, it's not forbidden by law, in fact, it is one of our main specialties. However, it is important to pay careful attention to numerous language and legal differences in the documents, issued in foreign countries. For instance, in Spanish and Latin American documents you can see the term 'Notario Publico', which, in fact, refers not to the notary but to a person who performs the functions similar to those of the U.S. attorney. Luckily, our lawyers are certified in legal translation and have spent years learning differences like this.
  • Can I notarize anything I want?

No, notarization has its own crucial requirements in terms of what documents can be approved by a notary office and what can not. There is a range of documents that cannot be notarized in any way since it disagrees with California law on the notarization process. If the document is allowed for notarization, there are still requirements that need to be met during the process of notarization. Usually, its the presence of the person who is presenting the document and the signature as the consequent proof of this presence. The notarization without the signature of the person who presents a document is also legally impossible. For example, if a student is presenting a transcript for the notarization, it's required that the document has the signature of the student, not simply of the school that issued the transcript. If the school's principal signature is the only signature in the document, the principal also has to come to the notary office. That said, the notarization of the signature is only possible in the presence of the author of the signature.
